Ube 服務條款

本條款規管你使用 Ube 交友應用程式（「本應用程式」）。本應用程式由 Pulsix Limited（兆禛有限公司）（「我們」）於香港營運。建立帳號或使用本應用程式，即表示你同意本條款及我們的私隱政策。如不同意，請勿使用本應用程式。

1. 資格

• 你必須年滿 18 歲。
• 你不得曾因違反本條款而被我們終止帳號，亦不得被法律禁止使用本服務。
• 每人只可擁有一個帳號。

2. 你的帳號

• 你提供的資料（包括年齡、相片及個人檔案）必須真實，並屬於你本人。
• 不得冒充他人，或使用他人的相片。
• 你須負責保管帳號及密碼，並為帳號下的所有活動負責。

3. 社群守則：零容忍

我們對以下內容及行為採取零容忍政策。違反者的內容會被移除，帳號可被即時停用或永久終止：

• 騷擾、欺凌、恐嚇、跟蹤，或在對方表示拒絕後持續聯絡。
• 仇恨言論，或基於種族、宗教、性別、性傾向、殘疾等的歧視或攻擊。
• 色情、露骨或裸露的內容，以及任何涉及未成年人的性內容。
• 暴力、威脅，或鼓吹自殘的內容。
• 詐騙、索取金錢或財務資料、投資或「愛情騙案」。
• 宣傳、招攬、廣告或任何商業用途，包括性交易。
• 虛假帳號、冒充他人，或未經同意分享他人的私隱資料或相片。
• 任何違反香港法律的內容或行為。

4. 舉報、封鎖及處理

• 你可以在應用程式內舉報任何會員或內容，並可封鎖任何會員，封鎖後對方將無法再聯絡你。
• 我們會在24 小時內審視舉報，移除違規內容，並停用或終止違規帳號。
• 上載的相片會經自動內容審核檢查。
• 如涉及人身安全或罪行，我們可能將資料提交執法機關。

5. 你的內容

你保留你上載的相片、文字及訊息的擁有權。你授予我們非獨家、免版稅的許可，在營運及提供本服務所需的範圍內，儲存、處理及向其他會員顯示這些內容。你確認你擁有上載內容的所需權利。我們有權移除任何違反本條款的內容。

6. 你的安全

我們不會對會員進行刑事背景調查，亦無法核實每位會員的身份或意圖。與其他會員交往時請保持警覺：首次見面請選擇公眾地方、告知親友行蹤，切勿向陌生人轉帳或提供財務資料。你須為與其他會員的交往自行負責。

7. 付費服務

• 訂閱經 Apple App Store 或 Google Play 收費。訂閱會自動續期，除非你在當期結束前至少 24 小時取消。你可隨時在 App Store 或 Google Play 的帳戶設定中管理或取消訂閱。
• 價格會在購買前清楚顯示。退款按 Apple 或 Google 的政策處理。
• Ube 點數屬應用程式內的虛擬物品，只可在本應用程式內使用，沒有現金價值，不可兌換現金或轉讓。除非法律或商店政策另有規定，已購買的點數不設退款。

8. 終止

你可隨時在應用程式內刪除帳號，詳見刪除帳號及資料。如你違反本條款，我們可暫停或終止你的帳號，毋須事先通知。帳號因違規被終止時，未使用的訂閱期或點數不設退款，除非法律另有規定。

9. 免責聲明及責任限制

本服務按「現狀」提供。在法律容許的最大範圍內，我們不保證本服務不會中斷或沒有錯誤，亦不保證你會找到配對。對於因會員之間的交往，或因使用本服務而引起的任何間接或相應損失，我們概不負責。本條款不排除任何依法不能排除的責任。

10. 條款修改

我們可能不時修改本條款，重大修改會反映在頁首的「最後更新」日期，並在適當時於應用程式內通知。修改後繼續使用本應用程式，即表示你接受經修訂的條款。

11. 適用法律

本條款受香港特別行政區法律管轄，並受香港法院的非專屬司法管轄。

12. Apple App Store 附加條款

如你經 Apple App Store 下載本應用程式：

• 本條款只存在於你與我們之間，並非與 Apple 之間。Apple 不對本應用程式或其內容負責。
• 你只可在你擁有或控制的 Apple 裝置上，按 App Store 使用條款所容許的方式使用本應用程式。
• Apple 沒有義務為本應用程式提供任何維護或支援服務。
• 如本應用程式未能符合任何適用的保證，你可通知 Apple，Apple 會退回本應用程式的購買價格（如有）；在法律容許的最大範圍內，Apple 對本應用程式不負任何其他保證責任。
• 任何有關本應用程式的申索（包括產品責任、法律合規及消費者保障），由我們而非 Apple 負責處理。
• 如有第三方聲稱本應用程式侵犯其知識產權，由我們而非 Apple 負責調查、抗辯、和解及解決。
• 你聲明你並非身處受美國政府禁運的國家或地區，亦不在美國政府的禁止或限制名單上。
• Apple 及其附屬公司是本條款的第三方受益人，在你接受本條款後，Apple 有權向你執行本條款。

Ube Terms of Use

These terms govern your use of the Ube dating app ("the App"), operated by Pulsix Limited ("we", "us") in Hong Kong. By creating an account or using the App you agree to these terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 18 years old.
• You must not have had an account terminated by us for breaching these terms, or be barred by law from using the service.
• One account per person.

2. Your account

• The information you provide, including your age, photos and profile, must be true and belong to you.
• Do not impersonate anyone or use someone else's photos.
• You are responsible for keeping your login secure and for all activity on your account.

3. Community rules: zero tolerance

We have zero tolerance for the content and behaviour below. Offending content is removed, and the account may be suspended immediately or terminated permanently:

• Harassment, bullying, intimidation, stalking, or continuing contact after someone has said no.
• Hate speech, or discrimination or attacks based on race, religion, gender, sexual orientation, disability or similar.
• Pornographic, sexually explicit or nude content, and any sexual content involving minors.
• Violence, threats, or content promoting self-harm.
• Scams, requests for money or financial details, investment or "romance" fraud.
• Promotion, solicitation, advertising or any commercial use, including sex work.
• Fake accounts, impersonation, or sharing another person's private information or photos without consent.
• Any content or conduct that breaks the law of Hong Kong.

4. Reporting, blocking and enforcement

• You can report any member or content in the App, and block any member so they can no longer contact you.
• We review reports within 24 hours, remove offending content, and suspend or terminate offending accounts.
• Uploaded photos are checked by automated content moderation.
• Where personal safety or a crime is involved, we may provide information to law enforcement.

5. Your content

You keep ownership of the photos, text and messages you upload. You grant us a non-exclusive, royalty-free licence to store, process and display them to other members as needed to operate and provide the service. You confirm you have the rights needed to upload your content. We may remove any content that breaches these terms.

6. Your safety

We do not run criminal background checks on members and cannot verify every member's identity or intentions. Take care when interacting with others: meet in a public place the first time, tell a friend where you are going, and never send money or financial details to someone you have not met. You are responsible for your interactions with other members.

7. Paid services

• Subscriptions are billed through the Apple App Store or Google Play. They renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel them at any time in your App Store or Google Play account settings.
• Prices are shown clearly before purchase. Refunds are handled under Apple's or Google's policies.
• Ube points are virtual items for use only within the App. They have no cash value and cannot be exchanged for cash or transferred. Purchased points are non-refundable unless the law or store policy requires otherwise.

8. Termination

You can delete your account in the App at any time; see Account and data deletion. If you breach these terms we may suspend or terminate your account without notice. Unused subscription time or points are not refunded when an account is terminated for a breach, unless the law requires otherwise.

9. Disclaimer and limitation of liability

The service is provided "as is". To the fullest extent permitted by law, we do not warrant that it will be uninterrupted or error-free, or that you will find a match, and we are not liable for any indirect or consequential loss arising from interactions between members or from your use of the service. Nothing in these terms excludes liability that cannot be excluded by law.

10. Changes to these terms

We may update these terms from time to time. Material changes are reflected in the "Last updated" date above and, where appropriate, notified in the App. Continuing to use the App after a change means you accept the revised terms.

11. Governing law

These terms are governed by the law of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction.

12. Additional terms for the Apple App Store

If you downloaded the App from the Apple App Store:

• These terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
• You may use the App only on Apple devices you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal compliance and consumer protection claims.
• We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple may enforce them against you.
